1. Introduction

  • These Terms and Conditions apply to RealView Images. Based in the UK, RealView Images provides AI Enhanced 4D ultrasound images. By accessing or using our website and services, you agree to comply with these Terms and Conditions.

2. Service Description

  • RealView Images offers a service where customers can upload a 4D ultrasound image, which we enhance using AI technology. Customers are then provided with the enhanced image via email for a fee, stated on the website and in section 5.

  • Service Limitations: Our AI Enhanced 4D images are intended solely for aesthetic and personal purposes and should not be solely relied upon for a true likeness of what babies will look like.

3. Eligibility

  • By using RealView Images, you confirm that you are at least 18 years old and legally eligible to enter into these Terms and Conditions.

  • With the details provided during order and payment submission, you are confirming full responsibility of these details being correct and to being the receiver of finalised images.

4. User Responsibilities

  • Image Ownership: You confirm that you are the owner or have the right to use and upload any image provided to RealView Images.

  • Non-Medical Use: You acknowledge that our services do not replace any form of medical imaging, diagnosis, or treatment. Always consult a qualified medical professional for any medical concerns.

  • Accuracy: RealView Images is not responsible for ensuring or creating accurate AI Enhanced 4D ultrasound images. Ethnicity of parents and skin tone is requested to support the accuracy of images created however we cannot guarantee an exact match. Although AI improves image clarity, reduces noise and sharpens key features, factors such as the position of the baby, movement and the amount of amniotic fluid can affect the accuracy. It is also important to note that limbs covering the face of the baby will also impact the accuracy and quality of images. AI's main role is to enhance the quality of the image, making it easier to identify facial features, but it does not guarantee an exact match to babies appearance at birth.

5. Fees and Payment

  • Fees for our services are displayed on our website. By uploading an image and confirming payment, you authorise us to process the specified fee. 

  • We offer two products, both individually priced. The cost of one AI Enhanced 4D ultrasound image is £12. The cost of one AI Enhanced 4D ultrasound image & live video is £15. 

  • Refunds: Confirmed orders are non-refundable. For any issues with images received, you must email RealView Images at admin@realviewimages.co.uk.

6. Intellectual Property Rights

  • Image Ownership: You retain all rights to your original ultrasound image. By submitting your image to RealView Images, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, and process the image for the purpose of providing our services.

  • RealView Images owns the right to use images received and subsequently any AI Enhanced 4D ultrasound images created for advertising and marketing purposes.

7. Delivery

  • AI Enhanced 4D ultrasound images and transformation videos will be delivered via the email address provided during the order and payment process. Delivery times may vary based on service demands but are typically completed within 3-5 days. If unexpected delays occur and you have not received your order, please don't hesitate to contact us via phone or email for assistance.

  • Accuracy of Contact Information: Ensure that your email address is accurate. RealView Images is not responsible for failed deliveries due to incorrect contact details.

8. Privacy and Data Protection

  • Data Collection: RealView Images collects, processes, and stores personal data in compliance with the UK GDPR and the Data Protection Act 2018. Collected data includes your uploaded image, contact details, and payment information.

  • Use of Data: Data is used strictly to provide, enhance, and improve our services, ensuring adherence to data security and privacy standards.

  • Third-Party Services: We may use third-party processors (e.g., payment processors) bound by GDPR compliance and UK data protection laws.

  • Data Retention: Uploaded images and related personal data are retained only for as long as needed to provide the requested service or comply with legal obligations. Images are stored securely for RealView Images only. There is no retention period limit for images provided and images produced.

9. Liability

  • Limitations: RealView Images is not liable for any damages arising from the use of our service, including any medical decisions or actions taken based on these images.

  • Disclaimer: As stated in section 4, RealView Images is not responsible for ensuring or creating accurate AI Enhanced 4D ultrasound images to a true likeness of what babies' will look like at birth or exact match to skin tone. RealView Images use advanced AI technology to enhance the quality of the image, but it does not guarantee an exact match to babies appearance at birth.

10. Prohibited Activities

  • You agree not to use the service for any unlawful activities, including, but not limited to, submitting images without permission or uploading altered images.

11. Amendments to Terms

  • RealView Images reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated on our website, and continued use of the service will constitute acceptance of the new terms.

12. Termination

  • We reserve the right to terminate your access to our services for any breach of these Terms and Conditions.

13. Governing Law

  • These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes will be resolved in UK courts.
